Cannabis Public Hearing September 17

On Tuesday, September 17, 2019, at 7 PM, the Winnetka Village Council is scheduled to hold a public hearing in the Village Hall Council Chamber at (510 Green Bay Road) for the purpose of considering amendments to the Zoning Ordinance concerning zoning regulations for cannabis-related businesses. Residents can contribute their opinion by either attending the meeting or writing to contactcouncil@Winnetka.org before 4:00 PM on Monday, September 16.

On June 26, 2019, State of Illinois Public Act 101-0027, titled the “Cannabis Regulation Tax Act” (the “Act”) was signed into law by the governor.  The Act legalizes the sale, possession, and use of cannabis and its derivatives (Cannabis”) for recreational purposes by adults over age 21 starting January 1, 2020.  The Act grants municipalities the authority:

  1. to regulate the zoning of commercial cannabis facilities including cultivation centers, dispensaries, infusers, processors, and craft growers (collectively, “Cannabis Businesses”) intending to serve recreational customers; this includes completely prohibiting the location and operation of Cannabis Businesses, restricting Cannabis Businesses to specific zoning districts, requiring Cannabis Businesses to obtain special use permits to operate and condition the granting of a special use permit on compliance with certain regulatory restricts.  
  2. to determine whether and under what conditions Cannabis Businesses may allow for on-premises consumption of Cannabis, and
  3. To impose a local retailer occupation tax of up to 3.0% of that retail purchase price of cannabis.

At the July 16, 2019, Village Council meeting, the Council passed a “Red Flag” resolution regarding the zoning of recreational Cannabis Businesses. The Council determined that it would be the body holding the public hearing on any proposed amendments to the Zoning Ordinance that would either prohibit or allow Cannabis Businesses in the community.
